Please read the conditions of use of MY DRESSING ROOM carefully. They are applicable to all sections of the application.
SCOPE OF APPLICATION
“MY DRESSING ROOM” is an on-line service (hereinafter and indistinctly; the "Service") provided on the Web site www.pronovias.com which provides a personal space (hereinafter, the "Profile") to users who expressly accept these Conditions of Use; giving them access to different functions that allow them to manage and organize different aspects of their weddings, exchange and share information and communicate with third parties invited by the user. The Web site www.pronovias.com and the private “MY DRESSING ROOM” platform are managed by SAN PATRICK, S.L.U. (hereinafter, “SAN PATRICK "), a company with registered address in Polígono Industrial Mas Mateu, s/n, 08820 El Prat de Llobregat, Barcelona, Spain, with Taxpayers' ID No. (CIF) B-63523609, Contact e-mail: info@pronovias.us.
These Conditions of Use regulate access to and use of the Service through the Web sites hosted with the domain names www.pronovias.com, www.pronovias.us, www.pronovias.mobi (hereinafter and indistinctly, the “Web site”) as well as any mobile applications that SAN PATRICK makes available to users at any time in the “Marketplaces” and/or “App Stores” for mobile handsets, and for all the contents displayed or made available to users of the Service.
These Conditions of Use are also applicable to the use and management of all tools and services made available by MY DRESSING ROOM to its users and by accepting these, users undertake to abide by these at all times. Likewise, the conditions of use applicable to each specific tool are also applicable to users, who must fully comply with all their content.
SAN PATRICK may extend, modify, reduce or delete MY DRESSING ROOM and the functions included in MY DRESSING TIME at any time and at its own discretion.
ACCEPTANCE OF THE CONDITIONS OF USE
All users of MY DRESSING ROOM expressly accept the Conditions of Use of the Service, and those of all tools available in this, declaring that they have read, accept and undertake to abide by these Conditions at all times. SAN PATRICK recommends that all users of the Web site regularly consult the Conditions of Use, which may be amended. Whenever you wish, you can consult the current version in the Conditions of Use section that appears in the MY DRESSING ROOM menu.
SAN PATRICK reserves the right, at its own discretion, to revise and amend these Conditions of Use at any time and for any reason. If the Conditions of Use are amended, SAN PATRICK will duly notify users of MY DRESSING ROOM of this. If users continue to use the Service they will be deemed to have tacitly accepted all the amendments. Users who do not agree to the changes may unsubscribe from MY DRESSING ROOM at any time, following the procedure provided for this.
These Conditions of Use may be complemented by SAN PATRICK through specific conditions that regulate use of certain services, applications and/or products offered on the Web site or, if appropriate, in the aforementioned “Google Play” and/or “App Stores” platforms on mobile terminals.
Access to some contents and use of some services, applications or products may be subject to certain specific conditions which, according to the case, will replace, complete and/or modify the MY DRESSING ROOM Conditions of Use. In case of contradiction, the terms of the Specific Conditions will prevail over those set out in the Conditions of Use.
LIABILITY FOR THE USE AND CONTENTS OF "MY DRESSING ROOM"
SAN PATRICK accepts no liability for errors in the contents of the Service. In this respect, SAN PATRICK acts merely as an intermediary which makes thistechnology platform available to users. SAN PATRICK's legal liability is limited to exercising the diligence required by law, because the content published by users in MY DRESSING ROOM cannot be moderated or controlled by SAN PATRICK, which will not review, use, distribute or share any content published by the user in MY DRESSING ROOM. SAN PATRICK therefore accepts no direct or indirect liability for the consequences of misuse by any user of the Service or the contents hosted there, the user is entirely liable for the contents of MY DRESSING ROOM, whether or not they are illegal, and for all and any damages that it may cause to SAN PATRICK or to third parties.
All contents included in MY DRESSING ROOM, whether public and/or transmitted privately between users by any means, is the sole responsibility of the user of MY DRESSING ROOM where the content is posted. Therefore, all users of MY DRESSING ROOM are responsible for reasonable use of the Service and its contents and, if appropriate, any SAN PATRICK mobile applications, according to the possibilities and purposes for which they are intended, complying fully and at all times with the terms set out in the Conditions of Use and Comments Policy of MY DRESSING ROOM. Moreover, SAN PATRICK accepts no editorial liability for the contents published in MY DRESSING ROOM, and to this effect, SAN PATRICK expressly declares that it does not identify with any of the opinions that the users of MY DRESSING ROOM may issue through the Service; thus users will be entirely liable for the consequences that may result thereof, as issuers of the contents as the user/administrator of MY DRESSING ROOM.
When publishing personal and proprietary content in MY DRESSING ROOM the user reserves all rights over the same. SAN PATRICK undertakes not to use, distribute or share any content published by the user; and, likewise, the user guarantees to SAN PATRICK:
- That the user is the owner and/or holder of the publishing rights and that, if appropriate, has obtained consent for this from third parties.
- That the user will abide by the laws governing the right to privacy, image and/or honor, intellectual property rights or any third party rights of individuals or companies.
- That, if the user publishes data of a personal nature of friends or third parties, they have been informed and the user has obtained their consent to publish the data in advance.
Because of this, each user is liable to SAN PATRICK for the accuracy of their statements, holding SAN PATRICK harmless for any complaints or claims by third parties in relation to the aforementioned statements and in relation to any legal rights on the contents that the user has published in the Service.
Likewise, each user will have the right to share, if they wish, the contents published in MY DRESSING ROOM, either with other registered users or with third parties, under their own responsibility, exonerating SAN PATRICK from all liability derived from public or private disclosure of the contents, which will be considered as private and personal by SAN PATRICK at all times.
However, SAN PATRICK reserves the right to delete, at the request of a third party, any content, opinion, information, comment, image or drawing that the user of MY DRESSING ROOM publishes, if a complaint is made using this form. The above provision does not imply that SAN PATRICK moderates MY DRESSING ROOM in any way, rather that it wishes to prevent, as far as possible, publication of any contents, comments or opinions that may be considered defamatory, racist, sexist, xenophobic, discriminatory, pornographic, violent or which, in any way oppose morals, public order or accepted morality, or which are clearly illegal are not published through MY DRESSING ROOM.
LIABILITY FOR THE OPERATION OF "MY DRESSING ROOM"
Under no circumstances will SAN PATRICK be liable for:
- Problems with access, availability and continuity of the Service and/or its functions, when these derive from factors outside our control and activity. Loss or damage of any type that may be caused by interruption, termination or malfunction of the Service, for causes not attributable to SAN PATRICK.
- Existence of viruses or other elements that may interfere with the IT system and/or mobile device.
- Loss and/or damage which may be caused by access and/or use of the user's account in the Service by unauthorized third parties. SAN PATRICK accepts no liability whatsoever for loss or damage caused to third parties due to illegal insertions in the user's profile in MY DRESSING ROOM, which is outside SAN PATRICK's control.
SAN PATRICK also reserves the right to restrict, suspend or cancel access to MY DRESSING ROOM, part of it and/or any specific function incorporated in the Service without prior notice and at any time.
"MY DRESSING ROOM" POLICY OF USE AND FORBIDDEN USES
The user undertakes to use MY DRESSING ROOM in accordance with the Law, these Conditions of Use, the Web site Disclaimer, accepted morality and public order. The user specifically undertakes not to use the Service for purposes that are illegal or contrary to these Conditions of Use, damaging to third party interests or rights, or to damage or render useless this Web site or the Service or hinder the use of the Web site and/or MY DRESSING ROOM by other users. Likewise, the user undertakes not to publish any materials that are contrary or may intend to be contrary to morals, ethics, good taste or decorum, or which infringe Industrial and Intellectual Property rights, Protection of Personal Data rights, and similar on the Web site and MY DRESSING ROOM.
Also, it is entirely forbidden to access or use of the Service for illegal, unauthorized purposes, with or without economic intentions, and the consequences deriving thereof will be the sole responsibility of the issuing user. Furthermore, the following uses are deemed forbidden and will be sufficient grounds for deleting a specific Profile if SAN PATRICK receives a complaint about them:
- Hosting, storage, revealing, publishing, distribution or sharing any material or information that is racist, obscene, pornographic, defamatory, misleading or fraudulent;
- The use of the service to insult, defame and/or damage the image and/or the reputation of PRONOVIAS, or any other brands owned by SAN PATRICK, or SAN PATRICK and/or any of the companies belonging to its business group;
- The insertion of computer viruses, defective files or hosting, storing, distributing or sharing any other material or computer program that may cause damage or change the contents, functions, programs or systems of www.pronovias.com;
- The use the Service to send advertising or sales messages, publishing marketing messages or gathering data for this purpose; or for sending mass e-mails and/or repetitive e-mail to numerous persons, or to use third parties' e-mails without their consent; or to gather e-mail addresses or any other contact details belonging to third parties to send messages without the consent of the addressee and/or to distribute unsolicited or unauthorized advertising, spamming activities, chain letters and/or similar;
- The use of the Service to organize any type of game of luck or chance whose participation implies payment of money or valuable objects.
Depending on the seriousness of the infringement and according to its own criteria, if you engage in any of the above behaviors, with or without economic consideration, SAN PATRICK reserves the right to suspend or cancel your Profile immediately and to remove any content from the profiles that infringe this list of prohibitions. SAN PATRICK will not accept any claims or complaints from users or third parties with regard to damages caused by the infringement or breach of any of the rights deriving from illegal use or use contrary to the Conditions of Use accepted by the user.
SAN PATRICK will act immediately if it receives a complaint regarding the infringement of third party rights, reserving at all times the right to delete any content which may be considered inappropriate, illegal or which is not expressly authorized by the owner. Likewise, if appropriate, SAN PATRICK may reveal and collaborate with the police and competent legal authorities if it detects any infringement of the law in force or it suspects a breach of the law or a crime, and shall provide the competent authorities with all the materials and/or contents published in MY DRESSING ROOM which are suspected to breach the applicable law and/or infringes or violates third party rights.
Pursuant to the above, SAN PATRICK reserves the right to suspend or cancel any user Profile automatically and without prior notice, and under no circumstances will such suspension or cancellation give any right to compensation.
RESPONSIBILITY FOR USER NAMES AND PASSWORDS
SAN PATRICK recommends users of MY DRESSING ROOM not to disclose their user names or passwords to any third parties, so that it is known to only the user who has created it and who uses and administers the Profile in MY DRESSING ROOM.
Each user will be responsible for custody of the password used to access the Service, as well as any activity or act carried out with the Profile. Likewise, SAN PATRICK recommends that all users of MY DRESSING ROOM protect their accounts with a password that is difficult to decipher, which includes combinations of capital and lower case letters, numbers and symbols.
Under no circumstances will SAN PATRICK accept liability for any consequences, results, damage or loss incurred, as a result of non-compliance by the user with the provisions above.
LIABILITY IN CASES OF IDENTITY THEFT
When SAN PATRICK receives a complaint through this form reporting that a third party's identity is being used by creating a Profile, it will check the identity of the user and if it confirms that the person's identity is being misused, it will immediately delete the Profile. SAN PATRICK declines all liability in this respect and shall not be required to restore the Profile under any circumstances. Likewise, if it is not possible to verify the user's identity, SAN PATRICK will also permanently delete the Profile.
For this purpose, you are hereby informed that SAN PATRICK may collaborate with and report to the police and competent courts if it detects identity theft, which may constitute a crime.
NOTIFICATION OF INFRINGEMENT OF RIGHTS
SAN PATRICK is concerned with protecting the rights of its users therefore, if a person or entity detects that their contents have been published on the Service without their consent, infringing intellectual property rights or the right to honor, privacy or image or any other right, they should notify SAN PATRICK using this form or by sending an e-mail to the address included at the end of these Conditions of Use and Privacy Policy and Personal Data Protection Policy (with the express subject matter "Infringement of Rights") and including the following information:
- Identification of the content, personal information and/or protected right that has been infringed.
- Identification of the content concerned in sufficient detail so that SAN PATRICK may locate it within the Service.
- Sufficient contact details so that SAN PATRICK may contact the complainant: e-mail and telephone number.
- A copy of the National ID Document, Passport or similar official document allowing for the user's identification.
- A signed statement that the complainant declares that the above information is true and that they are the legitimate owner (or is authorized to act on the owner's behalf) of the rights that have allegedly been infringed.
PRIVACY POLICY AND DATA PROTECTION POLICY
The collection and processing of personal data and exercise of rights over this information are governed by the Conditions of Use and by the Privacy Policy and Data Protection Policy.
OWNERSHIP OF "MY DRESSING ROOM"
SAN PATRICK is the creator of the tool “MY DRESSING ROOM” and is therefore the owner of all rights associated with the same. SAN PATRICK allows use of the Web site to registered users, however, this does not involve transference of any rights or benefits other than those established expressly in these Conditions of Use. MY DRESSING ROOM is one of the "covered elements" in the Legal Notice and will therefore be afforded the corresponding consideration and protection.
In compliance with the provisions of these Conditions of Use, SAN PATRICK, as owner of the Service, grants a limited license to third parties, which is revocable and non-transferable, to use the Service in a strictly personal manner. With the exception of the aforementioned license, any reproduction, distribution, public communication, modification and, in general, any act to exploit all and any of the contents (images, texts, designs, indexes, shapes, videos, etc.) contained in MY DRESSING ROOM, and the databases and software necessary to view or for the operation of the same, without prior express written authorization from SAN PATRICK, is totally prohibited.
None of the contents (images, texts, designs, indexes, shapes, etc.) forming the Web site and the functions of MY DRESSING ROOM may be exploited or used for commercial purposes, directly or indirectly, totally or partially, without prior written authorization from SAN PATRICK. If the user infringes this license, SAN PATRICK will cancel their Profile, notwithstanding any other consequences that may derive from the aforementioned infringement.
INTELLECTUAL AND INDUSTRIAL PROPERTY CONTAINED IN THE SERVICE
SAN PATRICK is the owner of all intellectual and industrial property rights relating to the Service and the contents found on the Web site that are published by SAN PATRICK, in accordance with the Legal Notice.
SAN PATRICK does not own and will therefore not be responsible for: (i) content published by users in MY DRESSING ROOM, which will continue to be their holder as established in these Conditions of Use; and (ii) content provided by third parties, for which they will be entirely responsible.
INTERNATIONAL CONDITIONS OF USE
The different services governed by these Conditions of Use will be managed by SAN PATRICK, a company that operates from Spain. Although these services can be accessed from outside Spain, you understand and accept that these have been drafted to be used by any person or entity in any country or jurisdiction where they are not against the law or local regulations applicable at the time.
Use of the Services included in MY DRESSING ROOM by users in a specific country is under the user's sole responsibility. The user alone is responsible for complying with the laws of the country from which the aforementioned services in MY DRESSING ROOM are accessed.
You are also informed that it is possible that some of the functions and/or services of MY DRESSING ROOM may not be available and/or function correctly in all countries due to technical and/or legal restrictions.
APPLICABLE JURISDICTION AND LAW
The regulations in force determine the laws and jurisdiction governing the relationship between SAN PATRICK and users of the Service. However, in cases where the current regulations do not foresee the obligation of the parties to be bound by a specific legal system, SAN PATRICK and the user expressly renounce all and any other legal systems that they could submit to and agree to be bound by the Courts of the city of Barcelona (Spain).
UNSUBSCRIBE FROM THE SERVICE
Users may cancel their Profile at MY DRESSING ROOM permanently through the Web site www.pronovias.com, using the “Cancel my Pronovias Profile” in the "MY DETAILS" section. If this option is chosen, the user will lose all the information in the account (e.g. friends, photographs, comments, etc.)
Please read the PETIT COMITÉ Conditions of Use carefully, which are applicable to the Administrator user.
“PETIT COMITÉ” is a function included in MY DRESSING ROOM that allows its users (hereinafter, the "Administrator") to share wedding dress designs included in www.pronovias.com which have been added to “MY FAVORITES” section of the Web site with a maximum of five people, with the sole purpose of sharing opinions and comments privately with the invited persons.
The Conditions of Use of the PETIT COMITÉ are complimentary to the Conditions of Use of MY DRESSING ROOM. By accepting these conditions, the user of MY DRESSING ROOM undertakes to abide by the following entirely the Conditions of Use of PETIT COMITÉ at all times.
Users accepting the Administrator's invitation (hereinafter, "Friends") will also be subject to the Conditions of Use of the PETIT COMITÉ, expressly accepting these, and in this respect they are bound to abide by these entirely and at all times. SAN PATRICK recommends that all users of the PETIT COMITÉ regularly consult the Conditions of Use, which may be amended.
SAN PATRICK hereby informs you that the information provided by the Administrator in order to invite five people to become part of PETIT COMITÉ will not be included in any databases managed by SAN PATRICK, given that the e-mail invitation is sent directly and personally to the user. This fact is stated in the invitation e-mail.
Sending this invitation does not mean that Friends are automatically registered in the Service. Friends must accept the invitation received from the user, accept the Conditions of Use and duly complete the registration process.
Friends will only have access to the PETIT COMITÉ but will not be able to view any other content or function of the registered user sending the invitation.
The Administrator will control and manage the contents of the PETIT COMITÉ at all times and may exclude any of the Friends from the PETIT COMITÉ at any time. SAN PATRICK undertakes not to use, distribute or share any content published by the user and their Friends.
SAN PATRICK is a mere intermediary with respect to the contents exchanged between PETIT COMITÉ users. SAN PATRICK will not moderate, control or review the content published by the Administrator or Friends. Because of this, the Administrator and the Friends are entirely responsible, respectively, to SAN PATRICK and third parties for the content sent, shared or published. If SAN PATRICK is informed, by way of this form of any inappropriate or illegal content, it will, at the request of the user, delete the content immediately.
The PETIT COMITÉ shall be operational from the moment when the invitations are sent by the user until two (2) months after the date of the wedding registered on the Web site of www.pronovias.com . After this time, all the contents introduced in PETIT COMITÉ will be deleted. An e-mail will be sent to the user's PETIT COMITÉ warning of its close.
SAN PATRICK will provide PETIT COMITÉ users with a notification service to the e-mail addresses provided by the user to inform them of news and changes made to your PETIT COMITÉ. The user accepts that this type of message is automatically included in the PETIT COMITÉ; however, the user may decide, at any time, whether or not they wish to receive these messages in the "MY DETAILS" section of the Web site. This message service will not affect any messages that SAN PATRICK may send you to:
- Recover your password if you forget it.
- Send new invitations to the desired persons.
- Notify you of news from the PRONOVIAS brand and the Web site of www.pronovias.com.
Please read the Conditions of Use of MY ALBUM carefully, which are applicable to the user.
MY ALBUM is a function that is accessible to registered users who have shown their interest in "wedding dresses and accessories" when registering on the Web site www.pronovias.com and who have bought their wedding dresses in a PRONOVIAS shop.
MY ALBUM is a function that allows users of MY DRESSING ROOM to upload up to 32 photos using an interface that makes it possible to build a photo album, introduce a descriptive text, save and print it.
The Conditions of Use of MY ALBUM are complimentary to the Conditions of Use of MY DRESSING ROOM. By accepting these conditions, the user of MY DRESSING ROOM undertakes to abide by the following entirely the Conditions of Use of MY ALBUM at all times.
Users of MY ALBUM guarantee that they hold all the necessary rights and permissions for editing, holding SAN PATRICK harmless from any third party claims in this respect. If the user edits third parties' photographs or comments of third parties' personal data, the user guarantees that they have been informed and that their consent has been obtained to edit and publish the data. SAN PATRICK undertakes not to use, distribute or share any content uploaded by the user to MY ALBUM.
Users of MY ALBUM may share the content included in it through their e-mails with the addressees of their choice. These messages will be made solely through the server that manages the user's e-mail address, therefore, SAN PATRICK declines all liability for any problems involving access, availability or continuity of MY ALBUM, and for loss or damage of any kind caused by the interruption, termination or malfunction of MY ALBUM for reasons not attributable to SAN PATRICK. SAN PATRICK also declines all liability for the existence of viruses or other elements that may cause changes in the user's e-mail when sending data from MY ALBUM, or for any loss and/or damage that, in the event, may be incurred by sending the content included in MY ALBUM sent by unauthorized third parties. SAN PATRICK accepts no liability whatsoever for loss or damage caused to third parties due to illegal insertions in the profile of the user's MI ALBUM, which is entirely outside SAN PATRICK's control.
SAN PATRICK hereby informs you that the information provided by the user to share data from MY ALBUM will not be included in any databases managed by SAN PATRICK, since the e-mail invitation is sent directly and personally by the user. This fact is stated in the invitation e-mail.
MY ALBUM shall be operational from the moment when the invitations are sent by the user until two (2) months after the date of the wedding registered on the Web site of www.pronovias.com . After this date, all the content introduced in MY ALBUM will be deleted. An e-mail will be sent to the user notifying them that MY ALBUM will be closed.
Please read the Conditions of Use of MY AGENDA and MY WEDDING PLANNER carefully, which are applicable to the user.
"MY AGENDA" is a function of MY DRESSING ROOM which allows the user to schedule appointments and tasks related to their wedding preparations.
"MY WEDDING PLANNER" is a function of MY DRESSING ROOM which allows the user to create a 'to-do' list and budget related to wedding preparations.
MY AGENDA and MY WEDDING PLANNER are functions that are accessible to registered users who have shown their interest in "wedding dresses and accessories" when registering on the Web site www.pronovias.com.
The Conditions of Use of MY AGENDA and MY WEDDING PLANNER are complimentary to the Conditions of Use of MY DRESSING ROOM. By accepting these, the user of MY DRESSING ROOM undertakes to abide by the following Conditions of Use of MY AGENDA and MY WEDDING PLANNER, entirely and at all times.
Likewise, with regard to the personal data included in MY AGENDA and/or MY WEDDING PLANNER that may be governed by Organic Law 15/1999, of 13 December, on Personal Data Protection (hereinafter, “LOPD”), and the data that SAN PATRICK may have access to, the user will be solely responsible for this data, and SAN PATRICK will only use this data with the purpose of rendering the requested services and, consequently, following the user's instructions. SAN PATRICK undertakes to keep the information and/or personal data included in the personal agenda secret. SAN PATRICK will not use this information for purposes other than to provide this service, nor will it publish, communicate or transfer it, not even for storage purposes, to other persons or companies.
If the user requests to unsubscribe from the Service and notwithstanding the applicable law, SAN PATRICK undertakes to delete their information and the information contained in MY AGENDA and/or MY WEDDING PLANNER at the time of the request. The user must therefore be aware that upon requesting to unsubscribe from the Service, SAN PATRICK will not store any copies of MY AGENDA and/or MY WEDDING PLANNER.
SAN PATRICK will guarantee the security and confidentiality of your personal data and all others published in MY AGENDA and/or MY WEDDING PLANNER, therefore, and notwithstanding the provisions set out in the Privacy and Personal Data Protection Policy included here, SAN PATRICK will process the information in MY AGENDA and/or MY WEDDING PLANNER with at least the basic security measures established in Royal Decree 1720/2007, of 21 December, approving the Regulation developing the LOPD.
The user of MY AGENDA and/or MY WEDDING PLANNER is entirely responsible for its use, holding SAN PATRICK harmless of all liability derived from any damage and/or loss for any correct or incorrect use thereof.
SAN PATRICK hereby informs you that the information provided by the user to share data from MY AGENDA and/or MY WEDDING PLANNER will not be included in any databases managed by SAN PATRICK, since the e-mail invitation is sent directly and personally to the user. This fact is stated in the invitation e-mail.
MY AGENDA
Use of this function and, particularly, synchronization of MY AGENDA implies express acceptance of these Conditions of Use and of the Data Protection Policy. Synchronizing allows users to transfer content from MY AGENDA to IPHONE and ANDROID operating systems.
The user's agenda will be stored in such a manner that SAN PATRICK will only store the agenda on behalf of the user without making any modifications/updates/uses other than those requested by the user. When synchronizing the user's agenda, the user undertakes to comply with the applicable Personal Data Protection regulations.
The user is solely responsible for the use of MY AGENDA with third party data; and SAN PATRICK shall under no circumstances be held liable for this, because it merely makes this function available to the user and does not moderate or control it in any way.
MY WEDDING PLANNER
Use of this function and, particularly, synchronization of MY WEDDING PLANNER with the APP for iPhone, iPod and iPad implies express acceptance of these Conditions of Use and of the Data Protection Policy. Because of this, before synchronizing with your agenda, you must first read and understand the conditions applicable to this function, and decide whether they meet your expectations and verify the availability of the function for your specific mobile device/s.
By synchronizing MY WEDDING PLANNER the user may transfer the content from MY WEDDING PLANNER to their iPhone, iPod or iPad.
The contents of MY WEDDING PLANNER will be stored in such a manner that SAN PATRICK will only store the data on behalf of the user without making any modifications/updates/uses other than those requested by the user.
