AI-POWERED VIRTUAL TRY-ON TERMS AND CONDITIONS

1. PURPOSE OF THE SERVICE
The Virtual Try-On allows users to generate a visual simulation using Artificial Intelligence based on a photograph provided by the user. Its purpose is to provide an indicative visualisation of Pronovias products.
2. NATURE OF THE SERVICE
The generated images are indicative simulations only. They do not represent an exact reproduction of the final appearance of the dress, its colour, drape, texture, fit or proportions, and they do not replace a physical fitting of the product.
3. ELIGIBILITY REQUIREMENTS
The user declares that they are of legal age or have the legal authorisation required to use the service. The user further declares that the photograph used belongs to them or that they have obtained the necessary rights and permissions to use it.
4. USE OF ARTIFICIAL INTELLIGENCE
The service uses Artificial Intelligence technologies to generate simulations. Generated images will be identified as AI-generated content.
5. PERMITTED USE
The user agrees to use the service lawfully and in accordance with applicable regulations. Uploading photographs of third parties without authorisation, unlawful or offensive content, or content that infringes image rights, intellectual property rights or any other rights of third parties is prohibited.
6. INTELLECTUAL PROPERTY
The designs, trademarks, logos, product images, content and other elements of the service are owned by Pronovias or its licensors. These Terms do not imply the transfer of any intellectual property rights relating to such elements.
7. OWNERSHIP AND USE OF GENERATED IMAGES
The image generated through the Virtual Try-On is created solely at the user’s request for the purpose of providing the requested service.
Pronovias does not acquire any exploitation rights over the user’s original photograph or the generated image, except those strictly necessary to technically process them, provide the requested service and comply with applicable legal obligations.
Pronovias will not use the original photographs or generated images for advertising campaigns, marketing activities, Artificial Intelligence model training, algorithm development or for any purpose other than providing the service, unless the user has previously provided specific, explicit and separate consent.
The user may download, retain and share the generated image for personal use.
The deletion of the original photograph and, where applicable, the generated image will be carried out in accordance with the retention periods established in the Privacy Policy. Users may exercise their data protection rights as described in that Policy.
8. DATA PROTECTION
The processing of personal data arising from the use of the Virtual Try-On is governed by the Privacy Policy, which forms an integral part of these Terms.
The use of the Virtual Try-On does not authorise Pronovias to reuse original photographs or generated images for purposes other than providing the service. Pronovias will process such images only to the extent strictly necessary to generate the requested simulation, make it available to the user and provide related functionalities.
Any subsequent processing for a different purpose, including marketing activities, advertising, commercial communications, Artificial Intelligence model training, algorithm development, behavioural analysis or any other purpose not directly related to providing the service, will require the user’s prior, specific, explicit and separate consent where legally required.
The original photograph and the generated image will be processed in accordance with the principles of lawfulness, fairness, transparency, data minimisation, purpose limitation and storage limitation established in Regulation (EU) 2016/679 (GDPR).
9. LIMITATION OF LIABILITY
Pronovias makes reasonable efforts to provide a quality service but does not guarantee uninterrupted availability of the Virtual Try-On or that simulations will perfectly reproduce the actual result.
To the extent permitted by applicable law, Pronovias shall not be liable for damages arising from the use of the service except where such liability cannot legally be excluded.
10. MODIFICATION OR WITHDRAWAL OF THE SERVICE
Pronovias may update, modify, suspend or withdraw the Virtual Try-On whenever necessary for technical, legal, security or business reasons.
11. APPLICABLE LAW
These Terms shall be governed by Spanish law, without prejudice to any rights granted to consumers under applicable legislation.
